Immigration Law Issues

Born in a small village on the beautiful tropical island of Mauritius, Shah Peerally moved to the United States in the 1990s, where he studied law. After graduating, he formed the Law Offices of Shah Peerally, which ultimately became the Shah Peerally law group. During his law school days, Shah was a witness to the sad events of 9/11, which naturally caused wide spread anger. Consequently, Shah noticed a lot of indiscriminate violence on the immigrant community in the US. As an immigrant and a law student, it was difficult for him to understand the motivation behind the religious extremism being rampantly practiced. His main concern then as it is now, is to save the immigrant community from unnecessary backlash and branding as terrorists. It was with this thought that he helped create the "Know Your Rights" guide for immigrants, which went on to become extremely popular, because it spoke as a voice for many immigrants. He later followed up with various speeches in different churches, temples and mosques teaching immigrants about their civil rights and how they should learn to fight back. Today, Shah Peerally is an attorney licensed in California, immigration law. The Peerally Law Group deals with issues related to the United States Citizenship and Immigration Services (USCIS), Immigration and Custom Enforcement (ICE) and Customs Border Patrol (CBP) under the Department of Homeland Security (DHS). Shah’s work has assumed meaningful proportions, especially with the assistance he provided to the students of Tri Valley University, during the scam that affected so many students from outside. As a lawyer, Shah has also acted as a face for many while petitioning the U.S. Government to change laws related to immigration that discriminate against innocent immigrants. As a part of his work in spreading the message of rights for immigrants and creating awareness, Shah has graduated to film-making under his home banner, Shah Peerally Productions Inc.. As a part of this, he has scripted the film Shattered Freedom which was selected at the Third World Movie Festival. In addition he is the executive producer of various sensitive films that deal with immigration issues, such as The Lost Dream, The Immigration Fraud, and The Immigration Interview. The films and his book are an attempt to highlight important problems with regards to immigration and the plight of immigrants. Book Review: The Immigration Lawyer: Asylum by Shah Peerally

Rightful liberty is unobstructed action according to our will within limits drawn around us by the equal rights of others. I do not add 'within the limits of the law' because the law is often but the tyrant's will, and always so when it violates the rights of the individual. Thomas Jefferson

This article is very related to the book.  Please give us your input.

As an Immigration lawyer, I have seen things done differently for different immigrants especially when they originate from the Middle East and South Asia.  Although I understand the fear of the United States, including my own fear, against people who want to harm the country, I still do not understand the discrimination towards the innocents.  The Book 'The Immigration Lawyer-Asylum' was written in this perspective based on my personal experience with the system. I might be wrong but the ACLU reportattached is very clear on the different treatment of people from the Middle East and South Asia.

A MOVIE ON DOMESTIC VIOLENCE AND IMMIGRATION LAWS.

By Shah Peerally, Esq.

www.Peerallylaw.com

Shah Peerally Productions proudly presents "Shattered Freedom," the latest episode in the story of  "An American Dream," from the series, "The Immigration Lawyer." Inspired by the hardships and struggles faced by Shah Peerally himself, as well as his law firm's and his own personal experiences as a career immigration lawyer, the film is an uncompromising work of fiction depicting the trials and tribulations of immigrants seeking to partake of the American Dream. It evokes the hopes and aspirations of all immigrants to America and unravels the challenges of the American legal system and ultimate assimilation into American society that virtually every immigrant can relate to.

The first part of the film recounts the story of a woman who has emerged from an abusive relationship and overcome insurmountable odds to arrive in America, only to see her dream shattered bit by bit. While the second part follows the journey of Ahmad, a man fleeing Iraq to the sanctuary of America, only to face an ordeal he had never imagined. But as with Shah Peerally's other films, "Shattered Freedom" incorporates real-life, firsthand experiences of immigration attorneys and attempts to cover a swath of major social issues related to immigration and immigrants, making the stories in this film more than just ordinary stories.

Produced entirely in the Bay Area in Northern California by Shah Peerally Productions, "Shattered Freedom" showcases new local talents, with direction by Renato Asuncion, Joe Barcelone and Manny Valencia, music by Mahesh Mishra, Parminder Guri, Samir Date, Somaiya Dipalee and Geeta Madhuri, and choreography by Anna Attrey. The cast includes Shah Peerally as a lawyer, and Pavneet Saluja, Jimmy Sidhu, Jagruti Shah, Sameer Khera, Naz Khan, Mohini Foryan, Harish Sharma, Waqas Younus, Chaz Laredo, Akram Khan, Pawan Bangar, Ritu Nischal, Navin Tekchandani, Jennifer Spence, Kasim Mohammadi, Hamed Rasti, Poonam Sansanwal, and a host of other gifted Bay Area individuals.

With its films, documentaries and radio shows, the Shah Peerally Production House endeavors to achieve its goals of (1) educating immigrants about their rights; (2) affording a chance to local talents; and (3) recognizing lawyers and other individuals fighting for human and civil rights.

Every year thousands of immigrants apply for American permanent residence through marriage. There are many immigrants in the US, some staying legally, many others illegally too, most of them want to stay over in the US and receive a green card. Green card through marriage is a commonly tried and tested method; where marrying an American citizen makes the spouse qualify for a green card and ultimately citizenship, which of course has to be approved by the immigration authorities. For this the beneficiary and the petitioner both have to go through an interview at the immigrations office, where they have to prove the authenticity of their marriage.

Since many years now Immigration has become a sensitive issue with plenty of queries being raised about the kind of people who have been migrating to the US. And while there is a lot of skepticism in the minds of US citizens about the need to grant addition citizenship to many immigrants, there are other concerns which are based on issues that veer towards racism, astoundingly in a Through their films the Shah Peerally Productions have always spoken about the concerns of the people. It is a curious situation that the viewers are presented with in the film when Holly and Victor meet Bill Benet, Jenifer Lawrence and Dan Jones, Department of Homeland Security USCIS Officer, Department of State Officer and FBI Special Agent respectively. The interview that follows is an extremely intricate scene in the film. It shows many shades and angles of what actually goes on, often within the confines of such interview sessions in the USCIS offices, how people react, motives, challenges and often opinions of the State versus the people.
Holly and Victor are a married couple, Holly is the petitioner in this case seeking a citizenship for her husband through marriage. While this is common in the country, because of plenty of cases where people have misused this right leading to defrauding the government with a sham marriage the immigration officers have become very vary of such cases. As is always the case in such instances, it is very difficult to judge a false case from an authentic one. The fine lines between suspecting immigration officers who think Victor is using Holy and the couple who seem to be in love, is beautifully brought out in the film.
In the end we see a lot of confusion between the couple, one must also grant the fact that they are like any other couple in such a situation under a great deal of stress and actually break up under the tension. Holly and Victor face the interview under stress and they seem to not only crack up but not tuned into each other too in many ways. What also comes through shockingly is the assumption of the officers and how they are determined to decide the fate of the petition even before the interview is over.
The film not only talks about the realities of life and immigration policies, rules and ways in which people use immigration policies as well as the attitude of the officers, it also teaches people about how they should be prepared for such interviews, face different situations and how they should never lie to the authorities.

"The Lost Dream" is a pure fiction inspired by true current events. The movie covers actual hardships faced by many skilled professionals as well as American businesses needing their services while trying to get a visa to enter the United States.

Directed by Renato Asuncion with Joe Barcelone as 'Trent', the president of a heavy weight IT American company and Naz Khan as their lawyer 'Sarah', The Lost Dream revolves around the gripping and exciting story of the break of the American dream.

Shah Peerally Productions Inc., in this movie is trying to make a difference in American Immigration history by uncovering the human face behind the non --immigrant visa applications. This film is their effort to showcase the increasing lack of transparency in the system that denies work visas to those trying legally to make a living in America by honest means.
The movie wants to bring to light three important messages:

1. The arbitrary and capricious use of INA 221 (g), the section of law which is holding many visa applications in limbo by the State Department and the unfair number of denials of L1 and H1B visas by the United States Citizenship and Immigration Services;
2. That legal immigration is healthy for the United States and the lack thereof can actually affect the United States economy; and
3. How the immigration system is a labyrinth which only experienced immigration lawyers can navigate and ignorance of the trade might result in a tragedy.

The story depicts an American company which goes through a nightmare because the key person behind the strategic technical support of the firm could not enter the United States on time. The fact that many Americans associated with this firm lost their jobs due to this incident is one of the factors that make this a sensational story.

The Immigration Lawyer - Asylum

The Immigration Lawyer Asylum - Shah Peerally

In the aftermath of the September 11, 2001 terrorist attacks, hundreds of individuals were arrested without being charged. While most of those arrested were never convicted of terrorism, their greatest vulnerability had been targeted—their status as immigrants, individuals with the vulnerable tag of being outsiders. The defunct Immigration and Naturalization Services were absorbed into one unit named the Department of Homeland Security. Under the Patriot Act and the Real ID Act, the immigrant community was forced to live in fear. Many were deported or disappeared. In this time of darkness, emerged a group of civil rights lawyers, guerrilla lawyers. These lawyers believed in the United States Constitution and were determined to fight for justice. Their faith and allegiance were often questioned, yet none of them gave up. Among this group was a less applauded group, which consisted of those faced with the actual challenge, the implementation of the immigration law and new challenges namely being considered guilty until proven innocent. These were the immigration lawyers. They fought for equal access to justice, which should never be decided by skin color, religion, or nationality. This is the story of some of those lawyers and their fight that helped others gain the courage to raise their voices against injustice.
